Founders following the Lean Startup methodology rightly “do unscalable things” to get to scale.  Brian Chesky and Joe Gebbia personally photographed Airbnb apartments. Pierre Omidyar  wrote the eBay core code over dinner to help his fiancee find Pez dispensers. The founders of  DoorDash spent months doing their own deliveries just to get feedback from customers.

You may have ignored formal IP work during the early stages of your company, and rightly so.  But every time you put one of your creations out into the world without protecting it, you are  creating prior art against yourself and making it harder to develop IP assets in the future. IP isn’t  just about trying to profit off your innovations – it’s also about protecting your freedom to  operate.

The Brandt & Co. IP team is composed of the people responsible for Sonos’ stature as the  holder of one of the most valuable patent portfolios in the world. We have developed over 1,100  patent assets and protected a vast array of trade secrets & trademarks. We’ve bought and sold IP, sought and written licenses, we’ve been on both sides of the courtroom in patent litigation – and we’ve won, every time.

We’re not just a bunch of lawyers. We’re a combined force of IP strategists, innovation leaders,  and patent attorneys, with the collective capability to help you leverage the power of strong,  strategically aligned IP development and portfolio management. Whether you’re looking to  increase your valuation, drive up the bottom line, boost assets on your balance sheet, reduce  risks as you expand overseas, extract value from the competition, or merely protect your  inventions against being copied, we can help.

1. Education

Our process starts by educating clients on the various types of IP instruments, why  they’re used, and how patents work. We’ll provide you with innovation strategies for  stimulating, generating, capturing and protecting IP. We’ll learn about your technological  capabilities, and how you differentiate your offering fin the competitive landscape. We  then prepare a taxonomy of invention, unique to your business, to guide and manage your ongoing portfolio development.

2. Strategy

First, we host a targeted capture session to collect and document IP relating to your  current products & roadmap. Looking forward beyond the current products & roadmap,  we will plan brainstorm sessions. Business objectives, adjacent markets, emerging  technologies, and competitive strengths all contribute to our ability to identify and  capture innovations for protection. We will guide you through the process of defining your intellectual property strategy, while ensuring close alignment with your overall  business objectives.

3. Execution

Once the strategic imperatives have been defined, it’s time to start executing.. We’ll  identify your company’s inventions, and work within your budget to ensure a portfolio  development plan that maximizes your IP protection & value with the resources you have  available. We’ll document each invention and ensure a clean, crisp identification of the  novel ‘hooks’ that will ensure strong patent protection (or trade-secret protection, should  we decide with you to elect it at this stage). Then, we hand off to our dedicated patent  counsel, who prepares and files the patent disclosure with the USPTO and/or foreign  equivalents. Should an office action be received from the patent office, we will manage  responses on your behalf to support your patent application all the way through  publication and issuance.
